公司公益捐赠正当性之法学与经济学探究

自2008年汶川地震以来,我国的公司公益捐赠呈迅猛发展趋势。公司公益捐赠在世界范围内经历了由禁止到限制再到允许的发展历程。公司公益捐赠的正当性是引导和规范公司公益捐赠行为所必须解决的前提性问题。公司公益捐赠之正当性根基有着深刻的社会经济原因,对其深层次剖析必须以公司公益捐赠在世界范围内的总体发展趋势为基本线索。公司公益捐赠,因市民社会与政治国家由冲突走向平衡而具有合宪性保证;因公司负外部性之弥合而具有公平性机理;因公司独立人格之深化而具有主体性支撑;因公司社会性与营利性之双重属性而具有义动性与利动性根基。     

略论凌廷堪的科举经历及对其学术的影响

凌廷堪的科举之路与一般人有所不同,他是通过纳资捐助获得了乡试资格,在经历了多次失败和漫长等待,终于获得选官机会。不过,凌廷堪毅然放弃县职,自选教职,此后便担任宁国府学教授,醉心于学术研究。凌廷堪科举之后"自选冷官"的原因值得探析,而且这一举动对其学术产生了更为深远的影响。

Explaining individual level support for organ procurement policy

The demand for human organs for transplantation – both from live and deceased donors – has become a public health issue in the United States, as thousands of Americans die each year due to the lack of a needed transplant. The current policy basis for organ procurement is voluntarism as federal organ procurement policy, based on the 1984 National Organ Transplant Act (NOTA), prohibits the exchange of human organs for “valuable consideration.” While an increasing number of policy analysts, including some ethicists, have advocated for financial incentives to induce more donations, a variety of factors – such as the legislative status quo, ongoing ethical concerns, and uncertain public support – have resulted in little use of financial incentives. We argue that a better understanding of public opinion is an important prerequisite for any move toward the use of financial incentives. Consequently, we develop and test a model to explain individual level attitudes toward legalizing and regulating the sale of human organs for transplant. We find that political ideology, gender, age and geographic region are important predictors of support.     

Not Your Average Teen Horror: Blood and Female Adolescence in Richard Bates’s Excision (2012)

ABSTRACT

Richard Bates’s film Excision (2012) uses blood as a metaphor to interrogate how cultural constructions of femininity affect the development of adolescent girls. Contrary to other horror films, which frequently depict adolescent girls as examples of the ‘monstrous-feminine’, this film about a girl who decides to perform a lung transplant on her sister explores the horrors caused by restricting conceptualisations of feminine bodies and identities. The film’s focus on blood interrogates problematic ideological connotations between menstruation and sexual promiscuity, and questions the veracity of supposedly realistic representations of the female body in contemporary advertising. Its protagonist’s adaptation of the ‘mad scientist’ persona gradually turns her into a character resembling Frankenstein, whose monstrosity highlights her inability to either conform to or escape from femininity as a cultural construct. Teen horror, the film suggests, is not caused by blood and bodily matter, but by extra-textual stereotypes and gender inequality.

Nonspecific Urethritis: Its Current Status

Abstract

The etiology, epidemiology, clinical presentation, diagnosis, and treatment of nonspecific urethritis (N.S.U.) is discussed. Chlamydia seems to be responsible for approximately 40–50% of cases while the etiology of the remainder remains obscrue. There seems to be reasonably good evidence for venereal transmission as well as for treatment of the female partner whether symptomatic or asymptomatic.

Tetracyline given for 21 days or oxytetracycline given for four days seem to be the most effective first line treatment regimens at this time.

Complications which include prostatitis, epididymitis, urethral stricture, and Reiter's Syndrome, are discussed. It appears as though there is a reasonable possibility that Reiter's Syndrome is a separate entity (or immunological sequela) rather than a complication.
